In order to protect the victims of domestic violence, a restraining order can be obtained. A retraining order is a court issued order that will protect the victim from contact with the abuser. It will prevent the abuser from coming within a specific distance of the abused or from entering the home, workplace or school of the family.

A retraining order is obtained in a civil court, and does not carry a jail sentence if the order is violated. Because it is issued by a civil court, it is a valid option for situations in which a law has not been broken, or the victims cannot prove that a law has been broken.

Houston Protective Order

A protective order is like a retraining order, in that it prevents an abuser from coming into contact with a victim. The difference between a restraining order and a protective order is that a protective order is issued by a criminal court and, therefore, carries a jail sentence in the case of a violation.

A protective order can prevent the abuser from coming within a certain distance of the victim, or from entering the home, workplace or school of the family. It can also prevent the children from being taken and stop the abuser from purchasing or owning any firearms.

A no contact protective order can also be issued, which will prevent any form of communication, including telephone calls and written communication. Under a no contact protective order, the abuser can only contact the victim through Houston protective order attorneys.
